Do I Have Grounds for a Personal Injury Claim?
While some injuries and accidents are truly blameless, most occur as a result of someone else’s misconduct. Negligence is a key factor in personal injury claims; you only have grounds for a case if you can prove that another person was negligent or acted outside of the law.
In order to have grounds for a personal injury claim in Pennsylvania, you must be able to prove all of the following elements:
- Duty of Care: You must prove that the other involved party owed you a duty of reasonable care. This means that they had a legal responsibility to take reasonable actions to prevent you from coming to harm.
- Breach: You must also prove that the other involved party breached the duty of care. Typically, this involves showing that the other party was negligent, reckless, or otherwise acted wrongfully (e.g. broke the law).
- Causation: In order to bring a successful claim, you will also have to prove that the other involved party’s negligent or wrongful conduct was the cause of your injuries and, had they not breached the duty of care, you would not have been injured.
- Injuries and Damages: Lastly, you must prove that you were injured or otherwise harmed and that you suffered measurable damages. These damages can be either economic or non-economic in nature and may include medical expenses, lost wages, or pain and suffering.
Just as in other states, you only have a limited time to file a personal injury lawsuit in Pennsylvania. The statute of limitations on personal injury claims in Pennsylvania is generally two years from the date of injury. If you fail to bring your claim within this timeframe, you will almost certainly be barred from seeking compensation for your damages.
How Our Attorneys Can Help
While you may have the legal right to file a personal injury claim, you could have trouble actually recovering the rightful compensation you are owed after a serious accident or injury. This is because insurance companies are hesitant to pay out claims, as doing so costs them money. They may employ any number of tactics to dispute or devalue your claim, possibly by arguing that you were at fault for the accident, that your injuries were the result of a pre-existing condition, or that the insured is otherwise not liable for your damages.
It is critical that you put an experienced attorney on your side. The insurance company will have its own legal team whose sole purpose is to dispute personal injury claims; you should have an equally powerful team fighting for you.
At Knafo Law Offices, we provide dedicated, aggressive legal representation to victims of serious injuries, accidents, and other traumatic events. Our firm is available 24/7 to take your call and advise you of your legal rights and options. We have what it takes to represent your best interests against the insurance company, and we are always ready to take your case to trial if needed to recover the full, fair compensation you deserve.
